Mother’s Day Diamond Dig Contest - Sunday, May 12, 2013
Official Rules and Regulations. Must be 21 years of age or older.
1) WHO MAY PLAY: Contestants must be 21 years of age or older. Photo ID required. Contest open only to Texas residents. Employees of Lone Star Park and their partially and fully owned subsidiaries and participating sponsor(s), and the immediate families of those employees are disqualified from participation. 2) TO ENTER: The first (500) women, ages 21 and over, to enter Lone Star Park’s Grandstand via the Grandstand turnstiles at the East and West entrance, beginning at 11:30 a.m. CDT and ending once (500) entry forms have been distributed, will receive an entry form to participate in the Mother’s Day Diamond Dig. One (1) entry form per person. Must be present on Sunday, May 12, 2013 to win. Selected entrants will be required to perform a physical task for the opportunity to win the prize and must be physically able to carry out the physical task without aid. By accepting an entry form, completing it and submitting it to participate in the Mother’s Day Diamond Dig, entrants agree to and accept all terms and conditions noted in these Official Rules and Regulations and Release Form. I am aware that the activity that I have agreed to participate in may involve many and various inherent risks, dangers and hazards which may include, but are not limited to: strain or pain caused by picking up, bending, digging, kneeling, or walking; exposure to sun and other outdoor elements; negligence of other persons, including, but not limited to, other participants in the activity; equipment failures; impact or collision with other persons or other equipment; serious physical exertion; aggravation of existing health problems; dirtying or damage to clothing and personal items; and the negligence on the part of the Releasees or of others, including the failure by the Releasees to safeguard or protect me from the risks, dangers and hazards referred to above. I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting there from. Entrants who do not agree to the above terms and those in these Official Rules and Regulations and on the Release Form will be disqualified from participating in the Contest, and by entering and participating in the Contest entrant agrees to and accept all such terms and waive or give up certain legal rights, including the right to sue. 3) THE DIAMOND DIG CONTEST: Immediately following the last live race at Lone Star Park on Sunday, May 12, 2013, eligible contestants should take their completed, original, unaltered entry form to the Winner’s Circle gates located on the East and West Grandstand apron. Lone Star Park is not responsible for missing, torn, worn or otherwise mutilated entry forms and replacements will not be provided. Following the last race, contestants will surrender their entry form in exchange for a spoon and will be escorted onto the main dirt track. Once on the track, contestants may not attempt to begin digging until the track announcer has indicated everyone may begin. Contestants who are witnessed to begin digging before the official start has been declared or who appear to harm the safety of others will be disqualified and will surrender their opportunity to participate in the promotion. Additionally, Contestants must remain within the perimeter of the designated digging area and may not begin digging outside the area. Failure to comply with these restrictions will result in elimination from the Contest without recourse. The Contestant who locates and obtains the official buried item and who presents it to the Contest Officials located in the Winner’s Circle will be declared the winner. In the event that digging has progressed for 10 minutes with no winner, Lone Star Park officials will decrease the size of the digging area and will continue to do so every 10 minutes until the buried item has been found. In the further event digging has progressed for an hour with no winner, Lone Star Park Officials will conduct a random draw from among entry forms received. Must be present to win. 4) IN THE EVENT OF RAIN/SLOPPY TRACK CONDITIONS: In the event of rain or if the Lone Star Park track crew determines the track to be of poor quality to bury the item on Sunday, May 12, 2013, the Diamond Dig area will be relocated. In the event relocation occurs, announcements will be made throughout the day. In the further event that weather prohibits any outdoor activity, a random drawing will be conducted to determine the winner. 5) ONE (1) GRAND PRIZE: Should a Contestant locate the buried item, and if there is compliance with the terms and conditions of this contract, that Finalist will win the Grand Prize of a diamond solitaire valued at approximately $2,500. Only one (1) Grand Prize will be awarded. In the event two (2) Contestants claim they located the prize, the Contestant who presents the buried item to the Contest Officials will be declared the official winner. Prize winnings or participation may not be substituted, transferred or assigned by participants. Submitting a completed entry form also indicates each Contestant agrees to an Affidavit of Eligibility and Liability/Publicity Release. Following the declaration of the winner, Lone Star Park will require the Contestant to sign additional affidavit and release forms. If the winner refuses to complete such forms, she will not be eligible to receive the prize. Should any prizewinner refuse a prize, Lone Star Park at Grand Prairie, their parent companies and each of their affiliates are released from any obligation and liability related to such prize. 6) TAXES: Liability for any and all Federal, State and Local taxes rests solely with the prizewinner. Any winner redeeming a prize valued at more than $500 must sign an affidavit confirming compliance with these Official Rules and Regulations of the Contest and must complete a W-9 form for tax purposes. 7) JUDGING: Lone Star Park at Grand Prairie, through its management, reserves the right to interpret all questions and conditions in regard to this event, without claim for damages or recourse of any kind. All questions not covered in these Official Rules and Regulations will be decided by the management of Lone Star Park at Grand Prairie, its decision to be final. 8) GENERAL: By presenting an entry form and participating in this Contest, participant agrees to and accepts these Official Rules and Regulations as detailed above. Prizewinners are obligated, and by entering agrees, to execute a Confirmation of Eligibility, General Release of Liability, Indemnity and Publicity Consent without further compensation, prior to being awarded any prize. Winners agree to hold Sponsor(s) and any participating promotional companies, as well as the prize provider, including their respective officers, shareholders, directors, employees, agents and representatives harmless from and against any and all claims or liability arising directly or indirectly from the prize or promotion. Non-compliance will result in disqualification. By entering this Contest, each Contestant agrees to the use of her name, voice, photo, biographical information and/or likeness for promotional purposes by Global Gaming Solutions and Lone Star Park at Grand Prairie without further compensation. 9) LAWS: These are the Official Contest Rules and Regulations. This Contest will be ruled by the laws of the State of Texas. This Contest is subject to all applicable Federal and State law. These Official Contest Rules and Regulations are subject to change without notice in order to comply with any applicable Federal and State laws. 10) INDEMNIFICATION: By entering this Contest, each Contestant indemnifies, releases and holds harmless Lone Star Park, their affiliates and each of their respective directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, including damage to shoes, clothing or other personal items, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, or participation in this Contest. 11) LIMITATION OF LIABILITY: Lone Star Park at Grand Prairie assume no liability for typographical or other errors in the offer or administration of this Contest, including, without limitation, errors in the printing of the offer and Official Contest Rules and Regulations, selection, notification and announcement of the winners, or distribution of the prizes. 12) TERMINATION: Lone Star Park reserves the right to modify the Official Rules and Regulations at any time without prior notice.
